Our site is a site operated by The Power Thread Inc.  (“we”, “our”, “us”).  We are registered in Delaware and have our headquarters in New York, NY. 

2. Our services

The POWER Thread is a for-profit company dedicated to connecting female power with style, for women to learn about products, fashion, and what being powerful means to women today. The POWER Thread interviews young women around the world.  The news and editorial content offered on our site are provided free of charge.  We reserve the right to change the cost of services, or to charge for other services, at any time.  

3. Accessing our site

Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.

When using our site, you must comply with the provisions of our acceptable use policy, as stated in section 4 below.

You are responsible for making all arrangements necessary for you to have access to our site.  You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms, and that they comply with them. 

4. Acceptable use policy

You agree that you will not, under any circumstances:

• Engage in any act that The Power Thread deems to be in conflict with the spirit or intent of the Site;
• Use the site in connection with any violation of any applicable law or regulation, or do anything that promotes the violation of any applicable law or regulation;
• Attempt to, or harass, abuse, or harm, or advocate or incite harassment, abuse, or harm of another person, group, including The Power Thread employees, including individuals featured in The Power Thread’s editorial and news Stories;
• Without The Power Thread’s express written consent, use the Site or any part thereof for any commercial purpose, including but not limited to, communicating or facilitating any commercial advertisement or solicitation.
• Make any automated use of the site, including but not limited to using any software, technology, or device to send content or messages, scrape, spider, or crawl the site, or harvest or manipulate data.
• Use, facilitate, create, or maintain any unauthorized connection to the Site or any The Power Thread feature, including without limitation (1) any connection to any unauthorized server that emulates, or attempts to emulate the Site, or (2) any connection using programs, tools, or software not expressly approved by The Power Thread.
• Except to the extent permitted by applicable law, reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for any underlying software or other intellectual property used to provide the Site, or to obtain any information from the Site using any method not expressly permitted by The Power Thread;
• Use any method to copy or distribute the content of the Site except as specifically allowed in this Agreement.

5. Intellectual property rights

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it.  Those works are protected by copyright laws and treaties around the world.  All such rights are reserved. All individual articles, blogs, videos, content and other elements comprising our site are also copyrighted works, and we (subject to the rights of our licensors and licensees under applicable agreements, understandings and arrangements) have all rights therein. You must abide by all additional copyright notices or restrictions contained on our site.

You may print off one copy, and may download extracts, of any page(s) from our site for your personal reference and you may draw the attention of others within your organisation to material posted on our site. 

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged.

You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

However, we are not affiliated, associated, authorized, endorsed by, or in any way officially connected with the companies whose products are mentioned, depicted, discussed or featured in our “Power Products” section. The product names, marks, emblems and images are registered trademarks of these third parties, not The Power Thread. Reference in this site to any specific commercial product, process, or service, or the use of any trade, firm or corporation name reflects the personal opinion of the individuals featured in our Stories, and does not constitute endorsement or recommendation by The Power Thread.

6. Reliance on information posted

Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed.  We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site, or by anyone who may be informed of any of its contents.

7. Our site changes regularly

We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.

8. Our liability

Opinions and other statements expressed by users and third parties (e.g., persons  featured in our Stories) are theirs alone, not opinions of The Power Thread. Content created by third parties is the sole responsibility of the third parties and its accuracy and completeness are not endorsed or guaranteed. You acknowledge that by providing you with the ability to view and distribute content through our site, The Power Thread is not undertaking any obligation or liability relating to the content. The Power Thread assumes no responsibility or liability which may arise from the content thereof, including, but not limited to, claims for defamation, libel, slander, infringement, invasion of privacy and publicity rights, obscenity, pornography, profanity, fraud, or misrepresentation.

Whilst we take every reasonable precaution and care in relation to our site, the material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

We accept no liability for any loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management or office time or for any indirect or consequential loss or damage of any kind however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

This does not affect our liability for any other liability which cannot be excluded or limited under applicable law.

9. Information about you and your visits to our site

You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

The courts of Delaware will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site. 

These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of Delaware.

Any changes we may make to these Terms in the future will be posted on this. You are also expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site.
